Holiday Inn Baguio asked to pay long overdue unpaid obligations

After facing a case with the National Privacy Commission for data privacy violation, Holiday Inn Baguio City Centre Hotel will now have to settle long overdue obligations with one of its contractors which has sought help from a local court for payment.

Judge Roberto Mabalot of the Municipal Trial Court Branch 1 has summoned officers of Vivotel Corporation, owner of the hotel along Legarda road, to appear before his sala within 30 days to answer complaints by Spiderone Construction Company Limited for unpaid maintenance services rendered to Holiday Inn.

In the September 21 summons signed by the clerk of said court, Elaine Bugayong, Vivotel’s president, managing partner, the general manager and key hotel officers are “commanded to enter” their appearance to the complaint filed by Spiderone within 30 days.

Spiderone is seeking payment of maintenance services rendered from September 2020 until February 15 of this year amounting to PhP949,928.57.

Last September 6 when Spiderone did not receive payment, it filed a complaint for collection of a sum of money and damages with a local court.

Holiday Inn and Spiderone entered into a service agreement in September 9 of last year.

Last August 11, Holiday Inn proposed a payment scheme for the payment of its obligation with Spiderone. However, the latter denied since “the payment has long been overdue.” It instead filed the case with the court “to protect its rights.”

Spiderone is also seeking for the issuance of a writ of preliminary attachment, that “if granted, will attach all properties, including garnishing of bank accounts of Vivotel Corporation, doing business as Holiday Inn Baguio City Center.”

Earlier, an employee of IHG Philippines, a sister company of Holiday Inn, filed a case before the NPC for violation of the data privacy.

Christopher de Vera of IHG Philippines filed the complaint last February 24 where he claimed the violation of his privacy has caused suffering to his family “due to the unauthorized access and use of my data, concealment of breach, unauthorized and malicious disclosure involving my personal information,…”

Since the pandemic started, Holiday Inn Baguio has been wanting on clients due to the lockdowns as well as the closure of Baguio from tourists.

There are also limited functions that is one of the bread and butter of most hotels.
